A Florida woman has filed a lawsuit against Delta Air Lines, claiming that she was seriously injured when a flight attendant repeatedly struck her with a beverage cart during a flight from Paris to New York, reports NY Post.
Gail Hamilton, the passenger, alleges that she was seated in an aisle seat on Delta Flight 263 on June 21, 2022, when the flight attendant “unexpectedly” hit her multiple times with a loaded cart, injuring her right shoulder. The incident occurred while the flight was en route to John F. Kennedy International Airport.
In the lawsuit filed in Manhattan federal court, Hamilton accuses Delta and the unidentified flight attendant of negligence. She claims that the airline failed to properly train its staff and ensure the safe operation of the beverage cart in the plane’s aisle. Hamilton is seeking unspecified damages for her injuries.
Neither Hamilton’s attorney nor a Delta spokesperson commented on the lawsuit.
This lawsuit adds to Delta’s recent legal troubles. Last week, the airline faced another lawsuit in the US district court in Georgia for allegedly refusing to issue refunds following a major technology outage caused by a CrowdStrike snafu. The outage, which occurred last month, resulted in the cancellation of hundreds of flights across the United States.
In a separate incident, a Delta flight was forced to make an emergency landing at JFK Airport after passengers were served contaminated food. The flight, traveling from Detroit to Amsterdam, was diverted after several passengers fell ill due to spoiled meals. Upon landing, 12 passengers were treated by medical personnel. The total number of affected passengers remains unclear.
A passenger named Virginia took to social media to express her frustration, writing on X (formerly Twitter), “Delta I need to know how you’re going to get me to Amsterdam today – I’m on the plane that’s emergency landing at JFK because you served passengers ‘contaminated’ food – I don’t need hotel/food vouchers I need to arrive in Amsterdam today.”
